The Americans with Disabilities Act Amendment Act of 2008: A Model Based Implementation Analysis

In 2008 Congress passed the Americans with Disabilities Act Amendment Act (ADAAA) which intended to broaden the original Americans with Disabilities Act's scope of protection. After passage, numerous questions remained regarding how the act should be implemented by the Equal Employment Opportunity Commission, the Department of Justice, and the federal court system. Within this paper, two policy models are combined and applied to the implementation of the ADAAA in order to test the appropriateness of model based policy analysis. Although not designed to explain implementation, the assumptions of Charles Lindblooms Incrementalism model and Amitai Etzionis Mixed Scanning model prove moderately effective at explaining the implementation of the ADAAA from the 2009 effective date up to the present day.
